Lasting Power of Attorney

Make Sure The Right People Can Act On Your Behalf

A Lasting Power of Attorney allows you to appoint trusted people to make important decisions for you if you're ever unable to do so yourself.

It's one of the most valuable documents you can have in place. It's also one of the most commonly overlooked, often until the moment it's needed and can no longer be arranged.

What Is A Lasting Power Of Attorney?

A Lasting Power of Attorney, or LPA, is a legal document that gives one or more people you trust the authority to make decisions on your behalf if you lose the ability to make them yourself.

Most people assume that their spouse, partner or children could simply step in if something happened. In reality, without the right legal authority in place, that isn't the case. A spouse cannot automatically access a joint account if it's frozen. A son or daughter cannot manage your affairs without the proper documentation, regardless of how close you are or how clearly you've expressed your wishes informally.

The people who love you most can find themselves unable to help you when it matters most, not because they aren't willing, but because they don't have the legal authority to act.

An LPA changes that.

The Two Types Of LPA

Property & Financial Affairs

This gives your chosen attorney or attorneys the authority to manage your financial life on your behalf. That includes bank accounts, household bills, property matters, savings and investments, and the day-to-day financial decisions that keep everything running. It can be used while you still have capacity if you want help managing your affairs, or it can be held in reserve for when it's needed.

Health & Welfare

This covers the decisions that matter most personally. Medical treatment, care arrangements, where you live, your daily welfare and, if relevant, decisions around end-of-life care. Critically, this type of LPA can only be used when you no longer have the capacity to make these decisions yourself, which makes having it in place before that point all the more important.

Many people choose to put both types in place, ensuring every aspect of their affairs is properly covered.

Why Is An LPA So Important?

A will protects your wishes after your death. A Lasting Power of Attorney protects your wishes while you're still here.

If you become unable to make decisions due to illness, injury or cognitive decline, the people closest to you will need to act quickly. Without an LPA, they can't. Instead, they face a lengthy and costly application to the Court of Protection just to obtain the authority to manage your affairs, a process that can take many months and creates significant stress at an already painful time.

The LPA doesn't just make things easier. In some circumstances it makes things possible at all.

This Isn't Just For Later Life

The most common misconception about LPAs is that they're something to think about when you're older.

The uncomfortable truth is that the need for one doesn't announce itself in advance. A serious accident, a sudden illness, a stroke, these things can happen at any age and without warning. The only point at which an LPA can be put in place is while you still have the mental capacity to do so. Once that capacity is gone, the option is gone with it.

Arranging an LPA isn't an admission that something is wrong or that you're expecting the worst. It's simply making sure that if something did happen, the people you trust are in a position to support you and that your wishes remain at the centre of every decision made on your behalf.

It's one of those things most people are quietly relieved to have sorted.
